About Free The Wind and SeaPeople WX Free The Wind is a campaign created by SeaPeople Inc. to provide access to SeaPeople WX and promote the idea that useful marine weather information should be broadly accessible. SeaPeople WX may provide features including: - Weather forecasts - Weather maps and animations - Multiple weather models - Model comparison - Route creation - Weather forecasts along routes - Weather-window tools - Wind, gust, wave, and other weather information - Location-based weather information - Anchorage-related weather information - Alerts, recommendations, or other planning tools - Additional weather or boating tools that we may introduce from time to time We may modify, improve, redesign, add to, or remove features of the Services except where doing so would conflict with a specific commitment made under the 100 Years of Free Premium Weather offer described below. ### 2. Your SeaPeople Account Free The Wind and SeaPeople WX use the SeaPeople account system. An account created through Free The Wind or SeaPeople WX is a SeaPeople account and may be used across other websites, applications, products, and services operated by SeaPeople Inc. Likewise, an existing SeaPeople account may be used to access Free The Wind or SeaPeople WX. Your: - Account identity - Email address - Account settings - Preferences - Marketing preferences - Product activity - Usage history - Weather activity - Other account-related information may be associated with the same SeaPeople account across SeaPeople-operated products and services as described in the Privacy Policy below. You are responsible for maintaining the confidentiality of your account credentials. The Services are intended for users who are at least 18 years old. ### 3. Our 100 Years of Free Premium Weather Commitment Free The Wind launched on October 12, 2026 with a simple principle: we believe the core weather information and planning tools boaters rely on should be accessible without a paid weather subscription. When we say “100 Years of Free Premium Weather,” we mean that SeaPeople is committed to continuing to provide access, without charge to access those core weather capabilities, to the features described below for 100 years from the launch of Free The Wind. #### Core Free Weather Features Our commitment applies to the following core capabilities: - **10-Day Forecasts** Access to weather forecasts extending up to 10 days, subject to the forecast ranges available from the underlying weather models and data providers. - **Hourly Forecasts for the First 48 Hours** Access to hourly forecast information for at least the first 48 hours of the forecast period where supported by the underlying forecast data. - **Basic Route Planning and Weather Along a Route** The ability to create a basic route and view forecast weather conditions associated with that route, including weather information or animation along the route over time. - **Weather Window Assessments** Access to a tool that evaluates forecast conditions against selected criteria, preferences, or comfort thresholds to help identify potentially preferable dates or times for a trip or departure. - **Forecast and Weather Model Comparison** The ability to compare forecasts from multiple weather models or forecast sources made available within SeaPeople WX. These are the Core Free Weather Features covered by our 100-year commitment. #### The Product Will Continue to Evolve SeaPeople WX is an evolving product. We expect its technology, interface, weather models, data sources, and features to change substantially over time. Our 100-year commitment applies to the core capabilities described above, not to any particular: - User interface - Feature name - Weather model - Model provider - Data provider - Algorithm - Visualization - Technical implementation SeaPeople may redesign, improve, replace, or otherwise change how a Core Free Weather Feature works while continuing to provide a reasonably equivalent core capability without a separate weather subscription fee. We may also add, remove, replace, or rename individual weather models or data providers as technology, availability, performance, licensing, or our product evolves. #### New and Advanced Features Our commitment to free core weather does not mean that every weather-related product or feature SeaPeople develops in the future will be free. As SeaPeople WX grows, we may introduce new, materially expanded, specialized, professional, or advanced functionality. Whether those features are offered for free or for a fee may depend on factors including: - User demand - Development and maintenance costs - Computing and infrastructure costs - Third-party data or licensing costs - The complexity of the feature - Whether the feature is intended for specialized, professional, or commercial use Future paid functionality may include advanced routing, automation, AI-powered tools, specialized datasets, enhanced alerts, professional products, fleet tools, or other capabilities that go beyond the Core Free Weather Features. A paid feature may enhance, automate, or build upon a Core Free Weather Feature, provided that SeaPeople continues to offer a reasonably functional free version of the underlying core capability described above. Future products or features may be offered for free, through a subscription, as a one-time purchase, or under another pricing model. SeaPeople will not charge you for a paid product or service without the authorization required by applicable law. #### Our Intent Free The Wind exists because we believe basic access to useful marine weather information is important to safe, informed, and accessible boating. Many capabilities we consider fundamental are commonly placed behind subscription paywalls. Our commitment is to keep the Core Free Weather Features above accessible without a separate weather subscription while allowing SeaPeople WX to continue building new products and advanced capabilities around them. #### Service and Third-Party Limitations Our 100-year commitment does not guarantee that: - FreeTheWind.com will retain its current name, design, or web address - SeaPeople WX will retain its current name or interface - Any particular third-party weather model will remain available - Any particular weather or data provider will continue operating - Any particular visualization, algorithm, or implementation will remain unchanged - Third-party data will remain available on its current terms If an underlying model, provider, technology, or service becomes unavailable, impractical, or commercially unreasonable to continue using, SeaPeople may replace it with another source or substantially equivalent functionality. Nothing in this commitment requires SeaPeople to continue providing a particular third-party product, model, dataset, provider, or technology that is no longer reasonably available to us. ### 4. Weather and Marine Safety Disclaimer SeaPeople WX and Free The Wind are informational tools. Weather forecasts are predictions. They may be: - Incorrect - Delayed - Incomplete - Unavailable - Outdated - Different from actual conditions Weather conditions can change quickly and may differ materially from forecast conditions. You should never treat a forecast displayed by SeaPeople WX as a guarantee of actual conditions. #### The Services Are Not Navigation Advice SeaPeople WX is not: - A replacement for professional judgment - A substitute for good seamanship - An official government weather service - A navigational chart - A certified navigation system - A replacement for required navigational equipment - A substitute for notices to mariners - A substitute for official marine warnings - Emergency communications equipment - Professional meteorological advice - Professional navigational advice You remain solely responsible for the safe operation of your vessel. #### Routes Routes created or displayed using SeaPeople WX may be used to associate weather information with a planned path. Unless expressly stated otherwise, SeaPeople WX does not verify that a route is: - Navigationally safe - Free of hazards - Sufficiently deep - Legally permissible - Suitable for your vessel - Suitable for your crew - Appropriate for the forecast conditions You are responsible for verifying navigation independently using appropriate charts, equipment, official information, and professional judgment. #### Optimal Weather Windows An identified weather window represents an analysis of available forecast data against selected criteria. It does not mean: - Conditions will occur as forecast - Conditions will be safe - Your vessel can safely make the passage - Your crew can safely make the passage - You should depart Final departure decisions remain entirely yours. #### Anchorage Information Any anchorage-related weather assessment, protection assessment, condition score, or similar information is informational only. It does not guarantee: - Holding - Depth - Swing room - Bottom conditions - Protection from swell - Protection from wind - Absence of hazards - Vessel suitability - Legal anchoring rights - Safe conditions Local conditions may differ materially from modeled conditions. #### Emergencies Never rely on SeaPeople WX or Free The Wind as your sole source of weather or safety information in an emergency. Use official authorities, emergency services, proper communications equipment, and appropriate marine safety resources. ### 5. Weather Models and Third-Party Data SeaPeople WX may display, process, interpret, combine, or visualize data produced by third parties. These may include: - Government weather agencies - Commercial weather providers - Numerical weather prediction models - Mapping providers - Satellite or observation providers - Other data partners Different weather models may produce materially different forecasts. SeaPeople does not create or control every piece of underlying third-party data. We do not guarantee the: - Accuracy - Completeness - Availability - Timeliness - Resolution - Update frequency - Continued availability of third-party data. References to third-party models, organizations, products, or trademarks do not imply sponsorship or endorsement unless expressly stated. ### 6. Acceptable Use You may use the Services for lawful personal or business purposes consistent with these Terms. You may not: - Circumvent security or access controls - Interfere with operation of the Services - Attempt unauthorized access to systems or accounts - Introduce malicious code - Scrape or bulk-download data without authorization - Use automated systems to extract substantial portions of the Services without permission - Reverse engineer non-public systems except where applicable law expressly permits it - Attempt to obtain proprietary algorithms or source code - Redistribute or resell third-party weather data in violation of applicable licenses - Impersonate another person - Use the Services for unlawful activity ### 7. Limitation of Liability TO THE MAXIMUM EXTENT PERMITTED BY LAW, SEAPEOPLE INC. AND ITS OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATING TO YOUR USE OF THE SERVICES. THIS INCLUDES DAMAGES ARISING FROM RELIANCE ON: - WEATHER FORECASTS - WEATHER MODELS - ROUTES - DEPARTURE WINDOWS - ANCHORAGE INFORMATION - WEATHER SCORES - WARNINGS - RECOMMENDATIONS - AI-GENERATED OR AUTOMATED OUTPUTS - OTHER INFORMATION PROVIDED THROUGH THE SERVICES TO THE MAXIMUM EXTENT PERMITTED BY LAW, SEAPEOPLE'S TOTAL LIABILITY ARISING FROM OR RELATING TO THE FREE SERVICES WILL NOT EXCEED US $100. Some jurisdictions do not permit certain limitations of liability, so portions of this section may not apply to you. ### 12. Suspension or Termination You may stop using the Services at any time. SeaPeople may suspend or terminate an account or restrict access if we reasonably believe that a user has: - Violated these Terms - Engaged in fraud - Abused the Services - Attempted to compromise security - Created legal risk ### 13. Changes to These Terms We may update these Terms as our products, technology, business, or legal obligations evolve. If a change materially affects user rights, we will provide notice where required by applicable law. Updates to these Terms do not change the 100 Years of Free Premium Weather commitment described in Section 3, except where a change is required by applicable law or falls within the product, technology, provider, and service limitations expressly described in Section 3. ## Part II — Privacy Policy ### 14.
